Library and User Regulations of the FH library of Dortmund University of Applied Sciences and Arts
The University of Applied Sciences has issued the following library and user regulations for the FH library on the basis of §§ 2 subsection 4 sentence 1, 29 subsection 2, 4 of the North Rhine-Westphalia Higher Education Act (Hochschulgesetz-HG of 16.09.2014 -GV.NRW p.547), last amended by the law of June 30, 2022 (GV. NRW. p. 780b):
§ 1 General
1) The FH library is an operating unit of Fachhochschule Dortmund.
(2) As a public academic library with a narrowly defined archive function, the FH library primarily serves research, teaching and studies at Fachhochschule Dortmund. In addition, the services of the FH library are also open to other citizens for professional and personal information and further education.
(3) The public-law user relationship between the user and the FH library is governed by these user regulations.
(4) The user acknowledges the user regulations by entering the FH library or by using its services. The user regulations can be viewed by anyone and will be handed out and published on request.
§ 2 Structure of the FH library
The FH library is located at the following locations:
a) Emil-Figge-Str. 44 (Faculties of Architecture, Computer Science, Applied Social Studies, Business Studies)
b) Sonnenstraße 96 (Faculties of Information and Electrical Engineering, Mechanical Engineering)
c) Max-Ophüls-Platz 2 (Faculty of Design).
§ 3 Library management
(1) The management of the FH library is the responsibility of a full-time director.
(2) The head of the FH library shall be appointed by the Rectorate of the University of Applied Sciences. The Rectorate appoints a deputy director on the recommendation of the director.
(3) The head of the FH library is the superior of the library staff.
(4) The director is responsible in particular for the following tasks
- Ensuring the proper fulfillment of the FH library's tasks,
- Informing the responsible university committees about all fundamental matters of the FH library,
- drawing up the budget of the FH library and the proper administration of the allocated funds,
- Participation in personnel matters of the library staff in his or her capacity as supervisor,
- drawing up the business distribution plan of the FH library.
(5) The head of the FH library is required to observe and implement resolutions of the responsible university committees concerning the library.
§ 4 Acquisition guidelines
(1) The FH library only acquires media that are required for the purposes of teaching, studies, research and development, artistic and creative tasks and further education in the disciplines represented at Fachhochschule Dortmund.
(2) The FH library does not acquire
(a) media for personal handsets that place an excessive demand on the FH library's budget,
b) media that are older than five years. Exceptions require special justification. This does not affect the temporary provision of these media at Fachhochschule Dortmund via electronic interlibrary loan,
c) Teaching materials,
d) instruction manuals, product catalogs, as well as popular science and fine literature or comparable media, provided they are not the subject of teaching, study and research,
e) media which are commercially available at a price of less than 10.00 EURO.
(3) The FH library supports other university units in the acquisition of media from their budgets.
(4) Media added to the FH library's collection are lent in accordance with the provisions of these Library and User Regulations.
(5) Suggestions for the acquisition of media can be made by all users of the FH library.
§ 5 Admission to use the FH library
(1) Members and employees of Fachhochschule Dortmund are entitled to use the library.
(2) Students and employees of Fachhochschule Dortmund use the FHCard as a library card.
(3) Other persons may be admitted to use the library upon presentation of a valid identity card or passport. The FH library may require this group of persons to present a confirmation of registration from the responsible registration office. The admission of minors requires the consent of a legal representative, unless the person concerned is a member or relative of the university.
(5) Authorities, associations and societies must name an authorized representative in their application for admission to whom the library card will be issued and who is authorized to borrow media.
(7) Compliance with the provisions of copyright law is the responsibility of the user.
§ 6 Opening hours
(1) The opening hours are determined by the head of the FH library in consultation with the respective deans according to the circumstances of the departmental libraries.
(2) The departmental libraries may be temporarily closed in consultation with the respective deans if this is necessary for auditing, inventory or other compelling reasons.
(3) The opening hours are announced on the notice board and on the library's homepage.
§ 7 Obligations of the users
(1) Every user is obliged to present any media, the contents of backpacks, bags, etc. and their library card to library staff on request. Otherwise, the instructions of the library staff must be followed.
(2) Luggage, umbrellas, other large objects, drinks in containers that cannot be firmly closed, food and animals may not be taken into the library rooms.
(3) The head of the FH library shall issue more detailed regulations for the use of the locker system at the respective location.
(4) Silence must be maintained in all rooms of the FH library that are accessible to the public, especially in the reading room areas. Telephoning is prohibited.
(5) The user undertakes to regularly check his/her email account registered with the FH library and to always keep sufficient storage space free in his/her email account so that messages from the FH library can reach him/her and to update his/her email address if necessary.
(6) The groups of persons named in § 5 para. 3 to 4 also undertake to inform the FH library of any change of postal address.
§ 8 Lending
(1) With the exception of the media mentioned in paragraph 2, all media are available for use outside the library (lending).
(2) The following are excluded from use outside the library rooms
- the last bound volume and loose-leaf issues of periodicals,
- loose-leaf works,
- works on loan,
- very valuable works,
- works that require special protection,
- boards and folders,
- reserve collections,
- other media which the head librarian declares cannot be borrowed (non-lending collection).
(3) Proof of identity in accordance with § 5 must be presented for lending.
(4) Borrowed media can be reserved. As soon as the requested item is available, the person placing the reservation will be notified. If a reserved item is not collected within seven opening days of the notification being sent, the library may dispose of it elsewhere.
(5) Information about who has borrowed an item or requested a reservation will not be provided for data protection reasons.
(6) The borrowed item must be returned at the latest on expiry of the loan period in accordance with § 9. If the loan period has expired, the fees specified in the Fees and Charges Regulations of Dortmund University of Applied Sciences and Arts Library (see also § 10) will be charged even without a prior reminder. Returning borrowed media by post is permitted. The borrower bears the risk of shipment
(7) As long as a user does not comply with the obligation to return media or has not paid any costs owed (fees and expenses), no further media should be lent to him or her. An automatic block occurs if the fees owed exceed the limit of 30.00 EURO. For users who are not members of the university, this limit is EUR 10.00.
(8) The head librarian shall issue more detailed regulations on the use of the FH library and lending.
(9) Works required for academic purposes that are not available locally can be ordered through the interlibrary loan system of German libraries (interlibrary loan). The expenses incurred when using the interlibrary loan service in accordance with the interlibrary loan regulations (resolution of the Conference of Ministers of Education and Cultural Affairs of 19.09.2003 in the version of 10.10.2008) in the currently valid version are to be reimbursed. Persons who are not members of the university are not admitted.
§ 9 Loan periods
(1) The library's loan periods (including renewal options for loan periods) are determined by the library management. The loan periods for the library stock in accordance with § 8 subsection 1 as well as all other formalities of the ordering and borrowing process are announced on the FH library website and on notice boards. In any case, the loan period ends with the termination of the user relationship.
(2) For revision purposes, all borrowed media can be reclaimed by the library even before the specified periods have expired.
(3) People with disabilities and significant impairments as a result may be granted special lending conditions.
(4) If the loan period is exceeded, fees will be charged in accordance with the current version of the Dortmund University of Applied Sciences and Arts Library's schedule of fees and charges. The fees are charged regardless of reminders. If a reminder is unsuccessful, administrative enforcement may be applied against the defaulting user in accordance with the Administrative Enforcement Act of the State of North Rhine-Westphalia.
§ 10 Fees and expenses
(1) The use of the FH library is generally free of charge. Any costs incurred (postage, copying or printing costs, etc.) shall be reimbursed.
(2) Otherwise, in particular in the case of § 9 subsection 4, the provisions of the Dortmund University of Applied Sciences and Arts Library's schedule of fees and charges shall apply.
§11 Measures to enforce the library and user regulations
(1) Anyone who violates these library and user regulations, commits illegal acts, in particular violations of copyright law and youth protection law, or otherwise disrupts the order of the library, may be temporarily or permanently excluded from use by the library director or restricted in use. The duration of the exclusion or restriction of use depends on the severity of the offense.
(2) The person concerned must be heard beforehand.
(3) The obligations arising from the use of the library remain in force.
§12 Liability
(1) The FH library is not responsible for the safekeeping of valuables and other items brought into the FH library. The FH library is not liable for their loss or damage.
(2) The borrowing process is completed when the item is checked out and handed over to the user. The borrower is liable for the medium from this point until it is returned. For lost or damaged media, the user must procure a replacement or bear the repair costs. In addition, administrative fees are charged in accordance with the Dortmund University of Applied Sciences and Arts Library's schedule of fees and charges.
§ 13 Data processing
(1) The university collects the personal data from users that is necessary for the lawful fulfillment of the tasks for which it is responsible. The data collected may be stored, modified and used manually and electronically by the university for the purpose of fulfilling its tasks. External service providers may be involved here.
(2) In particular, the following personal data is processed: Name, gender, email, private and/or work address, telephone number(s), assignment (faculty, central unit, administration, TU Dortmund University, other external), FH identifier, library number, borrowed media.
(3) The data collected may be transferred within the university if this is necessary for the fulfillment of the tasks for which the recipient is responsible. This data may be stored and used by the recipient insofar as this is necessary for the fulfillment of tasks. Data is regularly transferred within Department VI - University IT to the General Students' Committee (AStA) and the library for the purpose of the IT and other services used by the students there. The following data is transmitted: Matriculation number, surname, first name, gender, date of birth, address, study program, faculty, date of de-registration, user name, initial password, email, telephone, library card number. The initial password is only transmitted within Department VI - University IT.
(4) Data of persons who lose their status as members or affiliates of Fachhochschule Dortmund will be deleted at the beginning of the second calendar year following the loss of status. Data of persons who are neither members nor affiliates will be deleted at the beginning of a calendar year if these persons have neither borrowed media nor made reservations in the two preceding calendar years.
(5) The provisions of the European General Data Protection Regulation (GDPR) and the Data Protection Act of North Rhine-Westphalia (DSG NRW) apply.
§ 14 Entry into force
These Library and User Regulations enter into force on the day following their publication in the Official Notices - Announcement Gazette - of Dortmund University of Applied Sciences and Arts.

Schedule of Fees and Charges of the Dortmund University of Applied Sciences and Arts Library dated June 11, 2015 (Library Fee Schedule)
The University of Applied Sciences has issued the following fees and charges regulations for the University of Applied Sciences Library on the basis of §§ 2 para. 4 sentence 1, 29 para. 4 of the Higher Education Act of the State of North Rhine-Westphalia (Hochschulgesetz-HG) in the version of the Higher Education Future Act of September 16, 2014 (GV.NRW p. 547), in conjunction with § 2 para. 1 no. 2 Higher Education Fees Ordinance April 6, 2006 (GV. NRW. p. 157), last amended by Article 13 of the Higher Education Future Act:
§ 1 Principle
(1) The use of the library is generally free of charge.
(2) For the administrative activities and types of use specified below, fees, costs and expenses are charged in accordance with this scale of fees.
§ 2 Exceeding the loan period
(1) The fee to be charged per media unit if the loan period is exceeded is due when the loan period is exceeded and amounts to
- up to 10 calendar days: € 2.00
- up to 20 calendar days: € 5.00
- up to 30 calendar days: € 10.00
- up to 40 calendar days: € 20.00.
If a medium borrowed as part of the short-term loan is not returned on time, the fee is € 2.00 per borrowed media unit and calendar day.
(3) Exceeding the loan period by more than 40 calendar days or exceeding the deadline of 10 calendar days for the return of a medium borrowed as part of a short-term loan is considered a non-return within the meaning of § 3.
§ 3 Loss, damage, non-return
In the event of non-return, loss or damage to media or parts of media, the actual replacement or repair costs and an administration fee will be charged. The administration fee is charged in addition to the fee according to § 2 and in addition to the costs for repair, replacement or value replacement and amounts to € 25.00.
§ 4 Replacement of the library card
A fee of €10.00 is charged for the reissue of a lost or damaged library card.
§ 5 Interlibrary loan
A flat fee is charged for ordering media via interlibrary loan. The amount is based on the applicable provisions of the interlibrary loan regulations (resolution of the Conference of Ministers of Education and Cultural Affairs of 19.09.2003 in the version of 10.10.2008) in the currently valid version and corresponding regulations of the state government.
§ 6 Locker fees
(1) If the period of use of the short-term lockers is exceeded, a flat-rate fee of €2 will be charged.
(2) If the period of use of the long-term lockers is exceeded, the following fees apply:
- up to 10 calendar days: € 2.00,
- up to 20 calendar days: € 5.00,
- up to 30 calendar days: € 10.00,
- up to 40 calendar days: € 20.00.
§ 7 Fees for other services
The fees for other services provided by the library on special request within the scope of its mandate and possibilities, and for expenses incurred by the library in providing its services, shall be determined by the library management according to the expenses incurred, published in a separate list (Annex 1 to these regulations) and charged.
§ 8 Deferral, reduction and waiver of fees and charges
In exceptional cases, fees incurred may be deferred, reduced or waived in full upon application if their collection would cause particular hardship in the individual case. The decision on this is made by the library director.
§ 9 Entry into force
This Schedule of Fees and Charges shall enter into force on the day following its publication in the Official Bulletin (Amtliche Mitteilungen - Verkündungsblatt) of Dortmund University of Applied Sciences and Arts.
At the same time, the Fee and Charges Regulations of the FH library of Dortmund University of Applied Sciences and Arts dated May 26, 2010 (Official Notices - Gazette - of Dortmund University of Applied Sciences and Arts, 31st year, No. 32 dated June 17, 2010) shall cease to be in force.

Appendix 1
According to § 6 of the Fees and Charges Regulations of Dortmund University of Applied Sciences and Arts Library dated February 3, 2010, fees are charged for the following services:
- Processing fee for clearing a locker: € 5.00
- Fee for the replacement of a locker chip card after loss: € 10.00
- Usage fee for long-term lockers: € 5.00 (180 calendar days)
The fees for exceeding the period of use of a long-term locker are based on the rates stated in § 2.

Instructions for using the IT workstations and the Internet in the Fachhochschule Dortmund library
1. the offer
- The Fachhochschule Dortmund Library offers computer workstations with free internet access to members of the Fachhochschule Dortmund.
- The workstations are available exclusively for research, teaching and study purposes.
- To use the Internet, you need to register using the user number on your library card and your personal password.
- In addition to the Internet browser, programs for word processing, spreadsheets, presentation creation and graphics editing are available on the IT workstations.
- It is possible to save documents on external storage media with a USB connection.
2. compliance with criminal law and copyright regulations
- Users undertake to comply with the statutory regulations, in particular those of the Criminal Code and the Protection of Young Persons Act, and not to use or disseminate any illegal or otherwise violent, pornographic or discriminatory information or images at the IT workstations.
- The user is liable for violations, in particular against copyright, license and copyright regulations.
3. misuse of the offer, user liability
- If there is any suspicion of misuse of the service, the user must identify him/herself on request (library card). The instructions of the library staff must be followed.
- In the event of misuse of the service, the user may be completely or temporarily excluded from using it.
- The modification or manipulation of hardware or software at the IT workstations is prohibited. The user shall bear the costs of repairing any damage caused in this way.
We would like to draw your attention to the fact that data is often transmitted unsecured, especially on the Internet. Please bear this in mind if you wish to use services that request personal data, credit card information, bank details or passwords.
